Ordered from spicylingerie.com No items received was charged another $21.50 without my approval. $96.59 in charges need refund!

On February 8, 2011 I ordered two items from spicylingerie.com The order was intended to arrive for Valentine's day and I paid extra for 2-3 Priority Shipping. After missing Valentine's and waiting 8 days for someone to respond I decided to check up on my order. On February 16, 2011 I noticed that they removed one of the items from my order I had already paid for and charged me an additional $21.50 without my knowledge or approval.
I called several times and left messages along with 10+ emails stating that I wanted my order canceled and that I expected a full refund. There is no customer service just an answering machine and dead beat email accounts. They owe me a total of $96.59. I have already made a complaint with the BBB but nothing is happening. How do I receive a refund?

Hi Landon, I emailed you about this earlier. The order was placed after our Valentines day shipping deadline and without using the Express delivery that was explicitly stated was required for Valentines day. You were only charged $21.50, not $96.59, Please call your bank to verify that the extra $75.45 that you are calculating is a preauthorization placed on your card, it is pending, not a charge, and has cleared already. The reason you were charged $21.00 is because one of the items is on backorder, which I have since canceled for you as per your request. If you have any questions about this please respond to my earlier email.

You have no foundation to stand on. The order was placed in a timely manner, there was 4 business days until Valentine's and I would have been fine with it being late if my emails and phone calls would have been returned. Your website is false and does not honor the policy it provides. The live chat is a joke, no one answers the phone and you made the $21.50 charge without my approval so yes there was a total of $96.59 in charges from Spicy Lingerie. You had many options; If the item would have been listed as out of stock I obviously wouldn't have spent $60 bucks on an item you didn't have!
You also could have contacted me and told me it was out of stock and I would have picked out another item. Instead you forced me to worry about the situation for 9 days before responding with an explanation. I have contacted my credit card company and the $75.45 charge has yet to be restored, it could take weeks! If you plan on running a successful business you might want to start with a committed customer service and you should never under any circumstances make charges to someone's card without verifying first!

I do apologize but our website clearly stated that the order was not guaranteed for Valentines delivery and that all orders take a minimum of 2-3 business days for processing and up to 5-7 business days for item availability. I do apologize that you were unable to reach us during the holidays as it is an extremely busy time for us and we make every effort to respond to customers in a timely manner. Our website states the following: Due to constant changes in the marketplace, there is a small chance that the item(s) you ordered will be out of stock when your order is processed.
The $75.45 is not an actual charge, it is a pending authorization and should have cleared already, if for some reason it has not cleared please let me know and I would be happy to contact your bank to have it manually released.
